About these terms
These Terms of Use apply when you access or use treborservices.com (the “Site”), which is operated by Trebor Services Inc. (“Trebor,” “we,” “us,” or “our”). Please do not use the Site if you do not accept these terms.
These terms apply to the public Site only. Consulting services, platform access, demonstrations, investor materials, employment processes, and other relationships may be governed by separate written agreements. If there is a conflict, the applicable signed agreement controls that relationship.
Information, not professional advice
The Site describes Trebor’s perspectives, frameworks, capabilities, and services for general informational purposes. Its content is not advice tailored to your organization or circumstances and should not be treated as a recommendation for a particular decision.
Examples, diagrams, scenarios, outcome statements, and descriptions of potential value are illustrative. Actual results depend on an organization’s objectives, data, systems, governance, capacity, execution, and other circumstances.
No client relationship or confidential submission
Visiting the Site, sending an email, or booking an introductory meeting does not create a client or professional relationship. A relationship begins only when Trebor and the other party enter into an applicable written agreement.
Until we have entered into an appropriate written agreement, please share only general, non-confidential information through the public Site, Microsoft Bookings, or email.
Acceptable use
You may use the Site for lawful business and informational purposes. You must not:
- interfere with the Site, its infrastructure, security, or another person’s use;
- attempt unauthorized access, probe vulnerabilities, introduce malicious code, or evade technical controls;
- use automated means to extract content at a scale that burdens the Site or substitutes for permission;
- misrepresent your identity or affiliation, or use the Site in a fraudulent or unlawful manner; or
- infringe Trebor’s or another person’s intellectual property, privacy, confidentiality, or other rights.
Trebor may restrict access when reasonably necessary to protect the Site, users, or its rights.
Intellectual property
The Site and its text, visual design, diagrams, software, graphics, logos, names, and other content are owned by or licensed to Trebor and are protected by applicable intellectual property laws. AIF™, AIRS™, AIOP™, P2P Navigator™, NeXus™, Trebor Services, and related marks and branding may not be used in a way that suggests endorsement, affiliation, or ownership without written permission.
You may view, download, and share public Site content internally to evaluate Trebor, provided you do not modify it and preserve all ownership notices. You may not publish, sell, license, or create derivative commercial materials from Site content without written permission. No other licence is granted.
Third-party sites and services
The Site may link to third-party websites or services, including Microsoft Bookings. Those services are controlled by their respective operators and have their own terms, privacy practices, availability, and security. A link does not constitute an endorsement, and Trebor is not responsible for third-party content or practices.
Availability and accuracy
We aim to keep the Site useful and current. However, it is provided on an “as is” and “as available” basis and may contain errors or become temporarily unavailable. To the maximum extent permitted by law, Trebor disclaims warranties concerning the Site’s availability, accuracy, completeness, security, and suitability for a particular purpose.
Trebor may correct, update, suspend, or remove Site content or functionality at any time. References to future products, capabilities, or outcomes are directional and do not create a commitment to deliver them.
Limitation of liability
To the maximum extent permitted by applicable law, Trebor and its directors, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, opportunity, goodwill, or data, arising from or related to the Site or reliance on its content.
To the maximum extent permitted by applicable law, Trebor’s total aggregate liability arising out of or relating to your use of, inability to use, or reliance on the Site or its content, whether in contract, tort (including negligence), statute, or otherwise, will not exceed CAD $100.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence where it cannot lawfully be limited, death or bodily injury caused by negligence, or any other liability that cannot be excluded or limited by applicable law. Limitations governing paid services are set out in the applicable written agreement.
Privacy
Our Privacy Policy explains how Trebor handles personal information connected with this Site and provides access to current cookie and privacy choices. It forms part of the context in which these terms apply but does not reduce rights provided by applicable privacy law.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules. Subject to any rights or forum that cannot lawfully be restricted, disputes relating to the Site will be submitted to the courts located in Ontario, Canada.
Changes and contact
We may update these terms to reflect changes to the Site, our practices, or applicable law. The effective date at the top identifies the current version, and an updated version applies from that date. If you do not accept an update, please stop using the Site.
If a provision is found unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver of it.
